If a child were kidnapped in a small California town, the rest of California would be informed of it in the timeliest manner. Media has allowed people to be well-informed without letting time or distance get in the way of obtaining important knowledge. While media may be beneficial in keeping people filled in with up-to-date information, there are sides to media that are not as useful. Media has the ability to influence the way that people think and it has the ha bit of providing viewers, especially impressionable children and teenagers, with facts and images that are misleading and sometimes dangerous. People are presented with images of beauty and lifestyles that appear desirable, though they are really damaging.

Humanistic And Psychodynamic Perspectives Psychology Essay Psychology has been influenced by many schools and theorists it is always developing, growing and changing with society. In this essay I will identify, outline and compare two psychological theories. The theories I have chosen are humanistic theory founded by Carl Rogers and Abraham Maslow and psychoanalytic theory founded by Sigmund Freud and influenced by Carl Jung. I will be comparing these two theories, look at the conflicting differences between them and I will give my opinion in where I feel they sit in the Nature versus Nurture debate. I will discuss how both theories can be applied to social work as well as considering the cross cultural aspects and the implications of both theories in relation to indigenous peoples and gender. The humanistic school was founded later than the other two dominant schools of psychology, which are behaviour and psychoanalytic. Humanistic theory is often referred as the third force in psychology. (Humanism, n.d, para.2 and 3). Humanistic theorists felt that behaviourists focused too heavy on the behaviour of animals while the psychoanalytic theorists focused too heavily on the unconscious mind. The humanistic theory focuses on an individuals uniqueness. The humanistic perspective suggests that people are naturally good and strongly highlights self-actualisation with a majority of individuals choosing goal directed, adaptive and self-actualising behaviours. Theorists of humanistic perspective emphasise the idea that an individual has free will and is capable of choosing their own actions. (Approaches to Psychology, n.d., para. 1). It represents a positive view of human experience. Humanistic theory focuses on the element of the personality that are human based not animal or plant based. There are two well known theorists that have contributed to humanistic theory Carl Rodgers and Abraham Maslow. Carl Rogers (1902 1987) was an American Psychologist. He was considered one of the founding fathers of humanistic theory. He was well known for his person centred approach. He excelled in various areas such as student learning therapy and client centred therapy. In 1956 the American Psychological Association recognised his work and research and awarded him with the distinguished scientific contributions award and in 1972 he was given the award for distinguished professional contributions to psychology he was also nominated for the Nobel Peace Prize. (Carl Rogers, n.d, para. 1 and 2). Abraham Maslow (1908-1970) was an American Psychologist. He created a theory of self-actualisation called Maslows hierarchy of needs. Built up like a pyramid Maslow stated that when an individual has ascended to the top of the five levels he/she has reached self-actualisation. The five levels are physiological, safety, love and belonging, esteem and self actualisation. (Abraham Maslow, n.d, para. 1 and 10). Sigmund Freud (1856-1939) was the founding father of psychoanalytic theory, he is regarded to be one of the most influential theorists of the 20th century but he was also the most controversial and criticised theorist especially his Psychosexual development theory which Freud believed to be the foundation of development he outline five stages, Oral stage, Anal stage, phallic stage, latency stage and genital stage. Some of the people who were critical of some of his theories were his fellow psychoanalytic theorists such as Carl Jung and Alfred Adler who stated that Freud had over emphasised sexual instincts. (Sigmund Freud, n.d, para. 1 and 2). The underlying principles of psychodynamic perspective is that an individuals behaviour is largely the result of unconscious processes, motivation and early experiences. (Weston, Burton Kowalski, 2005, p. 25). Psychoanalytic theorists emphasise that a childs early experiences with their parents largely shapes development, behaviour and personality. Freuds unconscious mind theory includes the famous iceberg metaphor. The tip of the iceberg being the conscious mind (what we are aware of) and the bottom of the iceberg which is largely hidden under the waters surface is what Freud believed to be the unconscious mind (deplorable urges, feelings and thoughts). (Weston, Burton Kowalski, 2005, p. 12). Freud believed that the human personality was split into three parts the id, the superego and the ego. The id sits in the unconscious and it operates under impulse and impatience. The super ego is unconscious and it is the part that controls guilt as well as our sense of right and wrong. The ego is conscious and is the balancing and rationalising part of the mind it has to balance impulses of the id and the guilt of the super ego. (Santrock, 2008, p. 40) In the Nature versus Nurture debate, humanistic theory is considered Nurture because a persons behaviour is learnt from the environment which surrounds them as well as choice and free will. Psychoanalytic theory is considered Nature because it focuses on the behaviour of conscious and the unconscious mind. Humanistic and psychodynamic perspectives are the complete opposite of each other. Humanistic theory is centred around behaviour and mental process they criticised psychoanalytic theorists of being too focussed on the unconscious mind. (Theoretical perspectives in psychology, n.d, para. 3). Humanistic theory focuses on the positive influences of behaviour such as uniqueness, choice, self actualisation and free will while psychodynamic focuses on the negative influences of behaviour such as unacceptable sexual urges and deplorable thoughts. Humanistic theory emphasises that people are born good and psychodynamic theory emphasises that people are born bad and that everything people do has a selfish motive. (Theoretical perspectives in psychology, n.d, para. 2). Humanistic theorists emphasise that an individual has free will and choice and that an individual is influenced by the environment in which surrounds them. Psychodynamic theory emphasises that an individual has very little free will and very little self control and reject the idea of free will. Psychodynamic t heory focuses on the individuals dark side, the unconscious mind. Psychodynamic theorists believe that it is the force of the unconscious mind that shapes personality. The humanistic perspective focuses on how human behaviour can be changed or modified through self actualisation. They emphasise the central role of consciousness in shaping our behaviours, assuming that personal experience is a powerful medium for people to become more self aware and self directed in life. (Westen, Burton Kowalski, 2006, p. 17). Whereas the psychodynamic approach is that adult personality cant be changed it is set from a young age. (Theoretical perspectives in psychology, n.d, para. 2). The approach humanistic therapist or clinicians take is through empathy, warmth and respect. It is very person centred. The approach psychodynamic clinician would take is to interpret meanings through verbalised thought and behaviour. They would observe posture, fantasies and dreams which could be referred to as the s tudy of the mind not the study of the person and their environment. The social work profession is largely influenced by the humanistic approach. As Carl Rogers famously stated It is the client who knows what hurts, what directions to go, what problems are crucial, what experiences have been deeply buried. (About.com, n.d, para. 3). As a social worker in Aotearoa we work with a range of cultures and practice in a non judgemental way. The humanistic approach could be used across a range of cultures and still be highly effective for the client. As a social worker it is our job to work with clients not be the experts and the humanistic approach allows the client to reflect on the situation to find the answers instead of us telling them what they should change. The humanistic approach would be for the social worker to find out how the client perceives themselves and work with the client to recognise their inner strengths and potential in order for the client to achieve self direction, responsibilities and growth. Another humanistic model can be applied to social work through Maslows hierarchy of needs. This model would be very effective not only for the client but for the social worker, as they can get a clear understanding of what is going on in the clients life for example financial stability, housing, safety, childrens well being, domestic violence and how the client maybe coping in general. (Humanistic theories, n.d, para. 2). The psychodynamic approach in the application to social work would be allowing the client to talk about the situation in depth and the social worker listening, making notes and asking open questions to explore the situation more in depth. The psychodynamic approach focuses on the unconscious that are shown through the client behaviour and the client understanding how past experiences influence their present behaviour. (Psychodynamic therapy, n.d, para. 1). The psychodynamic approach helps the client to realise and explore their feelings which have been repressed into the unconscious mind. (Good therapy, n.d, para. 1). Social workers in Aotearoa work with a range of cultures therefore as practitioners we need to be culturally aware and sensitive. Not all psychological theories will fit with every culture or gender, we as social workers must consider the barriers to the application of different theories to different cultures. For example Psychoanalytic is a male established and driven theory which feminists may see as offensive because in their view they may see it as degrading also a lot of indigenous cultures work as a collective whereas Western culture is centred around survival of the fittest, the individual and because psychoanalytic focuses on the individual not the family it could be seen as highly offensive so it would be inappropriate and offensive to apply this theory in these two situations. Humanistic theory can be applied to a large range of cultures easily because of person centred approach; this theory is more adaptable to the collective family approach as well as the individual appro ach but its down side is that this theory was designed, established and tested on white middle class males the practitioner would have to keep that in mind when applying this theory in practice with different cultures. In conclusion to this essay I have identified, outlined and compared two completely different theories, it has been established within this essay that humanistic and psychoanalytic are two very conflicting theories with very different ideas and methods but both are two very influential schools within psychology. The theorists I have mentioned Sigmund Freud, Carl Rodgers and Abraham Maslow without a doubt heavily shaped and influenced psychology in their own ways. Both theories have very different approaches but both emphasise the importance of how adult behaviour is established by early childhood environment and experiences. In the application of social work this essay explains how humanistic theory is a positive more empathetic approach, it is person centred with the person reflecting and searching for answers whereas psychoanalytic approach focuses on the negative, the deep unconscious thoughts and is expert orientated. I have also considered cross cultural aspects of both theories and explained the implications in relation to gender issues such as feminism and race issues such as indigenous people and how applying these theories to different culture or gender may influence ineffective intervention.

One of his accomplishments was his famous tragedy; it was called â€Å"Romeo & Juliet†, written by Shakespeare at a somewhat connection in his literary career, most probably in 1594 or 1595. In Romeo and Juliet the main plot, in which the new love between Romeo and Juliet comes into conflict with the longstanding hatred between their families, is skillfully advanced, while the true development of minor characters supports and enriches it. The most complex of Shakespeare's early plays, Romeo and Juliet is far more than (2) â€Å"a play of young love† or â€Å"the world's typical love-tragedy.† Weaving together a large number of related impressions and judgments, it is as much about hate as love. It tells of a family and its home as well as a feud and a tragic marriage. The public life of Verona and the private lives of the Veronese make up the setting for the love of Juliet and Romeo and provide the background against which their love can be estimated. Is Torture a Necessary Evil Essay

14th September 2013 Torture is a necessary evil. After reading this article and evaluating both sides of the argument, my opinion remains the same. I disagree that torture is necessary; it is a barbaric breach of human rights. After looking at statistics, only 8% of Guantanamo detainees were Al Qaeda fighters, this is a shockingly low percentage in proportion to the 517 Guantanamo that were detained. British laws have deemed torture illegal and yet at least 6 detainees alleged that British forces were involved in the torture. Torturing cannot go on; the pros do not outweigh the cons of torture. In exceptional circumstances, lives may be saved, but at what cost? Where does it end, as stated in the article, will family members become torture victims? As the initial suspect may not have value for their own life, they turn to his/her loved ones? If a suspect has been detained, regardless of what their crime may be, they still have the right to remain silent. Any forced extraction of information goes against the fundamental human rights , and even if information is gained, what assurance do we have that it will be correct information? In the heat of the moment, it may seem that the information is true, to end the pain that the victim is in, yet it may all be fiction. These are clearly not risks worth taking, and in my opinion, anyone who is willing to submit a fellow human being to that amount of pain and discomfort, does not fill me with confidence in the fact that they are in a position of power. In recent news, countries like the UK or the USA are undecided whether to involve themselves in the business of Syria; they claim that involvement, in the sense of morals, is the right thing to do. Yet there is still a debate on whether torture should be legal, does one not contradict the other? It seems extremely hypocritical that on one hand, the armed forces have a sense of human rights in one way, yet on the other hand, claims that torture is necessary, which completely abolishes human rights in another way. In conclusion, regardless of the arguments in favour of torture, I still disagree that torture is a necessary evil; it dehumanises victims, stripping them of their human rights, regardless of whether they may be Al Qaeda fighters, they still ha ve the basic human right to remain silent during questioning, any way of obtaining information by forced means is morally wrong.

Capital Punishment and Sensitive Societal Issue

Punishment Punishment, Witness, and dehumanization are common in the world today illustrated in poems such as, â€Å"Punishment† by Seamus Heaney and â€Å"Capital Punishment† by Sherman Alexie. The poems give the world a different perspectives based on the authors viewpoint, yet both authors seem to favor punishment. Therefore everyone in their life deserves to be punished based on the authors work or even a witness for one reason or another to speak for something they have done or witness. These authors wanted to show a strong feeling towards punishment whether or not the crime was minor or major. In â€Å"Punishment† the speaker was a witness to dehumanizing punishment of the bog women. In â€Å"Capital Punishment† the cook was a witness to a cruel punishment. Even though both authors focused on different types of punishment they both expressed how witnessing and dehumanization have a vital role in different situations. Can punishment and race have factors that can change one another? Can the ethnicity of a criminal effect the severity of the punishment bestowed upon them? The ethnicity of a criminal or witness can determine how cruel and usual a punishment can be towards the criminal or witness. Witnessing is seeing an event, crime, or even an accident take place. In the poem the author talks about witnessing a horrible event. Punishment begins with a person possible the speaker or even the poet hanging with a noose around her neck and seems to be dead. The speaker seems like he could have witness the entire death. He describes the bog woman as, â€Å"she was a barked sapling that is dug out oak- bone, brain firkin: her shaved head like a stubble of black corn, her blindfold a soiled bandage, her noose a ring to store the memories of love† (Heaney, 1157). Even though he describes her as a scapegoat why does the speaker not speak up for this cruel dehumanizing punishment. The punishment was so outrages that the audience felt her pain. However, the speaker first says â€Å"my poor scapegoat† (Heaney, 1157), and we feel as if he feels the sorrow the readers do, shortly after he says, â€Å"I almost love you† (Heaney, 1157). With his participation of the punishment it leaves the audience believing that the woman deserves the punishment because of her past. â€Å"Capital Punishment† is told in first person, a cook is preparing a last meal for an Indian man. He says â€Å"I sit here in the dark kitchen when they do it, meaning when they kill him, kill and add another definition of the word to dictionary† (Alexie, 1164). The line â€Å"I am not a witness† is repeated throughout the poem, it is said after Alexie addresses a sensitive societal issue. Topics such as capital punishment are very difficult for the cook to explain. The speaker of the poem is sympathetic with the condemned man and knows that the reason he is on death row is due to the color of his skin. After the narrator describes and tells the reader what he is thinking and observing, he uses a line saying, â€Å"I am not a witness† symbolizing that the narrator can only imagine but relate to what the Native American is going through. He changes from â€Å"I am not a witness† to â€Å"I am a witness† (Alexie, 1162) when the narrator tells the reader a story about how the society can hang two people but throw both people in one grave. The line symbolizes that two wrongs do not equal one right. The cook sympathies with the criminal because he knows that his punishment is only that sever because of his ethnicity. I am a witness† is Alexie's way of saying this type of punishment is happening and is something that cannot be ignored or overlooked. The author asks the question, who are we to judge? Who decides someone's life is over? Alexie says at the end of the poem, † †¦ If any of us stood for days on top of a barren hill during an electrical stor m then lightning would eventually strike us and we'd have no idea for which of our sins were reduced to headlines and ash. † (Alexie 1165). Alexie was trying to say no matter what, a sin is a sin, the terms in which the sins were committed are meaningless, and the bottom line is that a sin was committed. However, if we were killed for our actions how would we know if the condemned would make up for that sin or turn out for the worst? Both poems prove that the author's point of view of each punishment in the poem shows significance in the writer's everyday life. Seamus Heaney's â€Å"Punishment† shows bitter love and can somewhat symbolize the relationship of the love of his life. Sherman Alexie's â€Å"Capital Punishment† symbolizes the punishment people experience especially through racial discrimination. In addition, by Alexie being Native American too, that proves he was making a statement about bitter punishment towards his culture. The ethnicity of a criminal or witness can determine how cruel and usual a punishment can be towards the criminal or witness. Starting a Business Letter with Dear Mr. Starting a Business Letter with Dear Mr. Starting a Business Letter with Dear Mr. By Maeve Maddox Several years ago, when a reader said he refused to use â€Å"Dear So-and-So† to begin a business letter because dear is too intimate a word to use with a stranger, I assumed that he represented a minority of one. Who, I wondered, would interpret an established convention like â€Å"Dear Sir† literally? Little did I know! I’ve recently stumbled across numerous articles with titles like â€Å"Is ‘Dear’ Dead as a Salutation?† I was amazed to find comments like these: From an English professor Rarely would anyone use dear when writing a friend, but it might be appropriate when applying for a job or emailing a boss. From a teacher Several men admitted they couldn’t force themselves to use Dear to address a business acquaintance, especially one they didn’t like. From a business consultant Dear comes across as too formal–or simply plain creepy and overly intimate.  And between men, the use of it can appear a bit too effeminate. I was surprised to learn that â€Å"rarely would anyone use dear when writing a friend.† When I lived in England, I wrote a lot of letters: to my parents, my brother, grandmothers, my aunts, and friends. Every one of those letters began with â€Å"Dear So-and-So.† Mind you, they were also written by hand with a fountain pen. Even now, on the few occasions that I write a letter to a friend with the intention of putting it in an envelope and mailing it, I still begin with â€Å"Dear.† It’s a convention. It’s courteous. It’s respectful. Just as bizarre as saying that one rarely begins a letter to a friend with Dear is the idea that using Dear to address a business acquaintance is a source of stress in grown men. Certainly, email has changed the way people communicate in writing. Because of its memo format and ease of sending, email has developed relaxed conventions for informal exchanges between friends and colleagues. For this kind of writing, a formal salutation is out of place. But even with email, a distinction is to be drawn between informal and formal communication. â€Å"Hi, So-and-So† is not a suitable way to address an unknown recipient from whom you want something. â€Å"Hey, So-and-So† is worse. â€Å"Dear Mr. Jones† and â€Å"Dear Ms. Smith† are emotion-neutral writing conventions. What I find â€Å"simply plain creepy† is the notion that the salutation Dear can be construed as â€Å"intimate† or â€Å"effeminate† in the context of a business letter. How to Decline a Job Offer With Class You’re job searching and you got an offer. Congratulations, that’s great- no matter how you slice it. Downside? You don’t really want that job. Either you’ve been offered something better, or you’re holding out for a more appropriate opportunity to your skill level and experience. Whatever the reason, if you need to decline a job offer with politeness and class- and without burning any bridges- here are five steps to follow for a graceful exit:1. Acknowledge.Don’t just let the offer letter sit in your inbox- or the offer message in your voicemail. Promptly acknowledge your receipt of the offer, making sure to reiterate your gratitude and sincere appreciation for both the offer and their time and consideration, and confirming timetables. When do they need your decision? Or if they haven’t imposed a deadline, suggest that you’ll get back to them with your answer by a certain (in the very near future) date.2. Stay in touch.Keep a l ine of communication open with you and the recruiter or hiring manager during your deliberation. You never know when a company might be open to negotiate to sweeten the deal for you. Not to mention, ignoring a company that’s just made you a job offer is a great way to look seriously unprofessional and childish. Put on your big girl panties and let them know where you are at.3. Dot your ‘i’s.Before you decline offer A (if you’re doing so because you also got offer B), make sure that you’re all finished with the preliminary on-boarding obstacles at job B before declining offer A. And please don’t post on any social media (especially LinkedIn) that you are accepting any offers until you’ve notified all companies you mean to decline and you’re well on your way to bringing in your plants and pictures to the job you are taking.4. Rip the Band-aid.The best approach, once you’ve decided, is to get your decline over with as quickl y and succinctly as possible. With an email or phone call, give a good brief reason, whatever that reason is. Either you’ve decided it’s not the best time to move/leave your current position/transition to a different role, etc. Or you’ve opted to pursue a position that allows you to be better challenged in one particular area of expertise. Or you’ve simply decided to accept an offer from another company- no further explanation needed unless asked. Elaborate only to the extent that it makes sense in the context of your prior conversations with this company. Remember that any intel you provide will help them in their hiring process and give them greater insight into their own process.5. Don’t ghost.Reiterate at this final stage how much you enjoyed meeting the team. You really enjoyed your conversations, yada yada. But why not stay in touch? Just because you declined an offer, provided you did so reasonably and with a certain degree of professionalis m and class, there’s no reason at all to go burning any bridges. Connect on LinkedIn to stay abreast of future employment opportunities. Reference a conference you might be attending together as a point of future contact. If none of this makes sense, simply state that the process was a pleasure and you wish them all the best.

Social Interaction of Those with Genius IQs - Essay Example In the course of the research, varying and opposing definitions of genius were arrived at. The term genius was at first referred to as a "man endowed with superior faculties" referring to some popular figures as the famous author and lexicographer Dr. Samuel Johnson, Albert Einstein, Immanuel Kant, Abraham Lincoln, Isaac Newton, Leonardo da Vinci and many others. It was also referred to as a quality, "that everyone possessed, an animating spirit that represented one's character and interests as much as one's ability". Through time, there were changes in the understanding of the term and was then associated with "one's natural ability or talent, and eventually with the special ability of a few". (Benet, 2005) In some other references as in the article of David Every, he insinuated to link genius to insanity, and gave a definition "an abnormal IQ, to the point where the person is 1.5 times as "logical" as the average person, or basically testing beyond the 98th percentile (3rd or 4th deviation)". (2006) Genius was also linked to psychoticism as some form of madness, "associated with an above-average level of psychological disturbance, though in combination with high general intelligence". (Brand, n.d.) However, in the more recent century, when the interests shifted to psychometric methods of assessment, the term genius became associated with the quantitative concept "Intelligence Quotient or IQ". Intelligence Quotient Intelligence Quotient or IQ is "the ratio of an individual's estimated mental age and chronological age multiplied by 100". Alfred Binet, a French psychologist developed the Binet-Simon Intelligence Scale in 1905 that measured the intelligence quotient. The initial IQ classification geared a scale of, IQ -140 and over as genius or near genius, 120-140 as very superior intelligence, 110-120 as superior intelligence, 90-110 as normal or average intelligence, 80-90 as dullness, 70-80 as borderline deficiency, 50-69 as moron, 20-49 as imbecile and below 20 as idiot. The classification changed in 1997 by the David Welcher - the Adult Intelligence Scale, which classified IQ -130 and above as very superior, 120-129 as superior, 110-119 as high average, 90-109 as average, 80-89 as low average, 70-79 as borderline and 69 and below as extremely low. Welcher's terminologies used were noticeably more considerate and humane and avoided type casting. The term genius was not used anymore. (Benet, C lassification n.d.) Intelligence and Genius The conflicting issue is that studies did not show clear relationship with IQ and the popular meaning of genius. It was noted that IQs of popular personalities were approximated in the above 130 or genius level. But the concept used is that of popularity. The word genius was derived from the Latin word, "gignere" which meant to beget or to produce. The reference to genius is one's ability to create something, which, the IQ tests did not measure. It scares me to think of the young lives in dysfunctional homes; how are they are taken advantage of, and how they can turn to porn for money or even attention. Role Of The Civil And Criminal Courts Law Essay The criminal and civil jurisdictions have many differences and some similarities in the way they deal with cases. In this court report I will be discussing the role of the civil and criminal courts by witnessing the law in action and will also compare and contrast the courts. Hierarchy of the Courts Below is a simple diagram of the hierarchy of the courts in England and Wales. All criminal cases are heard at the magistrates court, but for serious offences such as murder and rape it may be heard at the crown court. All civil cases start at the county court which deals with a range of issues from small claims to complex cases. If the case goes to appeal it will be heard in the courts listed above and it will follow the courts hierarchy. The doctrine of judicial precedent is also based on the courts hierarchy where the higher courts will bind lower courts on earlier decisions made. Criminal Jurisdiction: Crown Court To witness the law in action in a criminal jurisdiction the court that I visited was Minshull Street Crown Court in Manchester. The court mainly dealt with indictable offences and either way offences, which could be heard in the Magistrates Court or the Crown Court depending on what the defendant chooses. During the visit to the court I attended a trial which was a rape case. This was seen as a reconstruction case as witnesses had to be called to reconstruct what had happened in the case. The facts of the case are as follows. The defendant, the defendants sister (X), the victim and the victims brother (Y) after attending a family barbeque were quite drunk and so they all went to Ys house. While they were at Ys house they drank more alcohol. At this point the defendant and the victim were both very drunk. After feeling tired, the victim fully clothed decided to go to sleep on the sofa. The defendant slept in another room and X and Y slept in the same room. After waking up some time later the victim realised that she wasnt dressed in the same way that she had gone to sleep and physically felt as though she had sexual intercourse. Sat next to her was the defendant. The victim seeing the defendant ran to her X and Ys bedroom and told them what had happened and remained in their room. Seei ng the victim like this Y rushed down and assaulted the defendant and told him to get out of the house. The indictment was given to the jury after the facts of the case was told by the prosecution. The indictment set out the charges which the defendant was to be tried. It contained two issues: the first was whether the defendant intentionally penetrated with the victim and the second issue of whether the victim consented to have sexual intercourse. The first issue has been admitted by the defendant as he claims that he did have sexual intercourse with the victim, but the question remains of whether the victim consented. This case was heard in front of a judge and jury. The circuit judge had a very active role during the trial; he had to make sure the case is being conducted accordingly with relevant law and practice. The judges main role in the case was to direct the jury and also to give the sentence according to the case if the defendant was found guilty. Before the trial began the judge directed the jury on what they had to do and what they could not do. For example, they had to listen to the facts of the case, evidence and witness statements and decide whether the defendant is guilty or innocent. They were also told not to discuss the case outside court as the decision they give may be influenced and will not be seen to be just. The instructions that were given were clear and understandable and the jury seemed to have understood it. The jury consisted of twelve members as it was a criminal case. These members were aged 18-70, lived in the UK for five years since the age of thirteen and randomly selected from the electoral register to make it fair and represent the society. By having a trial by a jury it allows ordinary members of the public to get involved and know what is happening in the law. But more importantly, it allows the defendant to be judged by his own peers. Lord Devlin describes the jury as a little parliament and believes it is the lamp that shows that freedom lives. Clearly, this statement suggests that the jury is seen to be an important part of the legal system. The jury not only judges according to the facts of the case but also mitigates the harshness of the law as they decide the case according to what they think is fair and right. However, sometimes they may not be the right person to give verdicts as they are not legally qualified but more importantly they may get it wrong. For example, in the case of Pottle Randal  [1]  (1991) the defendant was acquitted even though there was evidence against him. This illustrates the point that the judgement of the case should be left to the judge and not the jury as sometimes they do not get it right. This also leads to inconsistency and loosing certainty in the law as the decision will vary from jury to jury. Many criticism have been made against the jury system, Darbyshire claims that juries are not random, not representative, but anti-democratic, irrational and haphazard legislators, whose erratic and secret decisions run counter to the rule of law  [2]  . During the trial the judge did not use the doctrine of judicial precedent when he summed up the case at the end and there was very limited use of statutory interpretation when the legal issue was addressed to the jury. This is because the jury had to decide the case and his role was to direct them. When the judge summed up the case, after the prosecution and defence presented and questioned their witnesses, he addressed the main points in the case and the legal issues in relation to those facts to the jury. This helped the jury to understand fully what they had to do. The main legal issue that was addressed was the definition of rape. However, the second part of the definition was explained to the jury as the case was concerning this issue and not the intention of the defendant. The second part concerned whether the victim had consented and whether the defendant reasonably believed that she had consented to the sexual intercourse and had freedom and capacity to make that choice  [3]  . The jury had to take this into consideration and whether the victim was able to consent while she was drunk. It was seen that the interpretation of the act given by the judge was given using the literal approach. The plain and ordinary meaning of the word was given to give effect to parliaments intention. The decision of the jury was based on the evidence, witness statements and the reconstruction of the case. At the end of the trial the jury were given time to decide the verdict. In the specific case the verdict was not guilty and the defendant was acquitted. The decision was made in secret. At this point it could be argued that this is seen as a weakness of the jury as we are not able to know how they reached such a decision as there is no explanation given. Civil Jurisdiction: County Court Majority of civil cases are heard at the County Court, many of which are private. Due to the matters being private many will try and resolve their dispute outside of court, with very few cases going to trial. However, if the parties wish they may still go to court with t heir claim. Some civil courts that I attended heard many private disputes which were not available for the public to sit in at. However, at Manchester County Court I was able to attend a trial, this was a property case. The summary of the case was stated by the prosecution at the beginning of the trial. The facts of the case are as follows. The defendant and the claimant lived together for sixteen years. In 1989 they purchased a house which was under the claimants name. In 1996 the house was remortgaged and the claimant sold the house to the defendant for  £85,000 at a profit of  £20,000. The money obtained was used to pay off the mortgage payment by the claimant which was  £44,000 and the rest ( £31,000) was put into the claimants gold deposit account. When the property was first purchased it was seen as a joint venture by the parties even though the property was under the claimants name. However, after the property was sold to the defendant it was claimed that the there was no trust ar ising between them and it was no more or no less than just a remortgaging exercise. But the claimant claims that even after the remortgage they were still living together and the property was seen as a joint venture and they both still had a close relationship before the break up in 2006. The issue arising in this case is whether there was a relationship between the claimant and defendant in order for the claimant to obtain her share of the property. This case was heard by a district judge alone. The role of the judge was to establish the facts and to apply relevant law to the case followed by a reasoned judgement at the end of the trial. The defendant and the claimant were both cross examined by the prosecution and the defendant and were also questioned by the judge on certain issues that was considered to be important. This allowed both parties to provide their point of view and evidence to support their argument in the case. During the trial the doctrine of judicial precedent was used by the prosecution to support the argument he was presenting. To establish that there was trust between the two parties Lord Hoffmans statement in a House of Lord case was used where it sated that trust can be established between the parties. The doctrine of judicial precedent plays an important role in the English legal system. It is based on stare decisis where the previous decision of a higher court stands. This is seen to be binding on all lower courts. So it will be seen that the judge must consider the case when the judgement is given. However, the judge may not have to follow the previous case and can distinguish it on the basis that the facts of the case are different, but if the facts of the case are the same the case can be used. Many parties can go to court to solve their dispute. However, there are alternative methods available for civil cases rather than going to court. Alternative Dispute Resolution Alternative Dispute Resolution (ADR) is another method of resolving a dispute rather than going to court. ADR is part of a continuing contest over the dominance of courts in the apparatus of state law  [4]  . ADR may be more relevant to civil matters than criminal matter as it mainly focuses on disputes involving parties, however, it could also be used in criminal matters depending on the nature of the case. Both litigation and ADR have their strengths and weaknesses when the methods are used. ADR is cheap, less formal, flexible and quicker compared to litigation. But most important of all it protects the relationship of the two parties as there is no winner and no looser. However, if parties do not compromise it may take long for the dispute to be solved also the decision made in many types of ADR is not legally binding such as negotiation, mediation and conciliation. On the other hand, with litigation it is expensive, formal and a more complicated process compared to alternative ADR. Furthermore, it can be time consuming and not flexible enough to suit the parties. However, a decision is always given at the end, which is legally binding and enforced through the courts. As to which method is used depends on the parties and the nature of the case and how complicated it is to solve. ADR is a more convenient way to resolve a dispute than using litigation as there are many more advantages in using this method than going to court. Comparison of the Criminal and the Civil Court There are many differences in the criminal and the civil jurisdiction in terms of the purpose of action, concern, parties involved, standard of proof, the decision and the court in which the case is heard (illustrated in the diagram above). Criminal law is concerned with offences against the state. In order for the defendant to be found guilty the burden of proof is on the prosecution to prove that the defendant is guilty beyond reasonable doubt. The courts of criminal jurisdiction are concerned with punishing the wrongdoer. On the other hand, the civil jurisdiction is concerned to resolve the legal dispute between the two private parties. The standard of proof is also different as it is on the balance of probabilities. These differences are reflected in the cases which were heard at court. For example, in the criminal court the case was to establish that the defendant was guilty of rape beyond reasonable doubt where as in the civil court there was no need for the prosecution to do t his. Conclusion Overall, the courts are distinct in the cases that are heard. The role of the judge in each court was different but was seen to be very important. The courts are seen to be very important for parties that bring their cause of action to court as a person with legal knowledge is able to help them and decision given is binding and legally enforced to do right to the party that has been wronged. The United States of America is not leading into the direction our country was meant to lead. Our Forefathers that came before us and settled in the United Sates, fled here to be free from tyranny. They were escaping from Great Britain’s strict control and harsh taxation. After settling in America the Constitution was drafted to â€Å"form a perfect Union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the Blessings of Liberty to ourselves and our Posterity (Preamble to the United States Constitution).† After reading the preamble, I reread, and wondered how can the US be in the situation were in, if that is what our country ‘was’ built on? What direction is our country headed in, how is taxation hurting or benefiting us, and what can we do to better ours and our children’s future? If Americans were required to pay for government spending this year, we’d have to work an extra thirty-eight days to earn enough money to pay all our taxes. Approximately forty seven percent of Americans will not be eligible for any income tax return, but because of EITC (Earned Income Tax Credit) and other credits implemented by Obama and Bush a majority will receive a tax credit. I am a supporter of tax credits, but I also think that there should be a ‘cap’ to limit your tax credit. Doing this could provide a credit for everyone, but having a limit can help to utilize money in many different areas. Our Forefathers that came before us and settled in the United Sates, fled here to be free from tyranny. They were escaping from Great Britain’s strict control and harsh taxation. Australian Life Life in the Bush The Australian life style was portrayed as one of the bushman although it was not . The life of a typical Australian was really the city life . The bushman was one with no classes and he treated every person as equal . A middle class person was the same as a working class man . The bushman was a very trust worthy and helpful character he would help a stranger as if it was his friend and if that friend needed anything he would be glade to ofer him every thing he has . The bushman lead gypsy like lifestyle with the constant moving and roaming round the country side . They would often walk or ride horse back from place to place with their tent and billy and camp out over night when they had no where to stay . The bushman where very much like aborigines they tracked and did not need a compass or a map they knew plants and trees . They called this bushcraft . A bushman would cook , clean , wash his cloths and patch his pants this made them very independent . If a bushman was ordered or commanded he would say " Are you talking to me or the dog ? " they treated everyone equal and wanted to be treated equal . They dressed in tweeds , flannel tops , with blue jumpers in the cold and yellow oilskin jackets in the rain . They wore hard wearing blucher boots and broad felt hats . The bushman would often have a drinkdown the pub . They often told stories to each other as their past time . The bushmans homes were made from slabs of bark , green hide . The houses were simple and didn't always show advantage . Nor dose it have to , the bushman's home (bellow) is there to shelter him . Struggle for Individuality Essay

The autobiography, Black Boy, follows the life of Richard Wright and his experiences as a young African American teenager facing racism in the South. Throughout the novel, Wright focuses on the oppression society inflicts upon him. He finds difficulty in remaining employed because he does not act â€Å"black† or submissive enough. He is physically and emotionally attacked for being African American as the majority of the South contains an extremely racist culture. Wright does not even have his family to rely on for support because they criticize and beat him as well. Differences within his family along with incidences of violent attacks and disrespectful language plague Wright and try to deplete his confidence and identity. However, Wright simultaneously finds measures within these aspects to gain back his individuality and happiness. He fights back through violence to uphold his right of walking safely in Memphis; he uses all of his ability to avoid beatings from his family, and he finds joy and sense of worth when he writes stories. Ultimately, Wright struggles to keep his sense of identity in a society that degrades his persona, but manages to obtain his individuality in the end. Through violence, Wright begins to understand that society is laying out a persona for him to accept that is not initially his. In the South, he learns he must accept the role as the meek and respectful â€Å"nigger.† Wright experiences violence one day that teaches him how whites expect him to act in the South. Wright recounts, â€Å"The car stopped and the white men piled out and stood over me. ‘Nigger, ain’t you learned no better sense’n that yet?’ asked the man who hit me. ‘Ain’t you learned to say sir to a white man yet?’† (181). Wright is smashed between the eyes with a glass bottle when he does not answer a white man by â€Å"sir†. The repetition of questions from the white man illustrates the authority the white man feels over Wright. The white man questions Wright as if he is an uneducated child. His word choice of â€Å"sense† portrays that saying â€Å"sir† to a white man should be common sense. After this incident, Wright â€Å"[learns] rapidly how to watch white people, to observe their every move, every fleeting expression, how to interpret what was said and what left unsaid† (181). He treats and studies white people delicately to ensure that he does not upset the balance between the higher  citizen and lower citizen, and thus does not have to suffer their brutal consequences. As Wright learns he is unable to act naturally, society gradually shapes him into what it thinks he should be. Wright recalls, â€Å"all the violent expressions of hate and hostility that had seeped into us from our surroundings, came now to the surface to guide our actions† (83). Wright’s utilization of the â€Å"h† alliteration in â€Å"hate† and â€Å"hostility† emphasizes a heavy â€Å"h† sound to reinforce the thickness and greatness of their conflict, that their differences were not just on the surface, but blood deep. The â€Å"s† alliteration in the word, â€Å"seeped,† â€Å"surroundings,† and â€Å"surface† creates a low, rattling â€Å"s† sound to create a sense of savagery in their actions. As Wright grows, he begins to experience the segregation between white and black. He also begins to accept the role of an angry African American that society casts him to play. He learns that he must act as a quiet and obedient â€Å"nigger† as he is constantly beaten whenever he acts otherwise. Wright’s family also takes away his freedom to be himself as they consistently beat him. In one incidence, he tells of the time his Uncle Tom was infuriated with the way he speaks. His uncle says, â€Å"I never heard a sassier black imp than you in all my life† (157). Wright does not understand what he said or what he did wrong; yet his uncle is persistent in beating him, believing that Wright does not know how to live with people. Wright asks â€Å"How long was I going to be beaten for trifles and less than trifles?† (158). Wright’s questioning of time illustrates the weariness he feels toward his family. He cannot endure any more beatings over trivial matters. Because of his family members, Wright is trapped in his grandmother’s home. He is unable to speak freely as his family members find him impolite. The one place that Richard Wright should feel comfortable, if nowhere else, is his own home, but he is so alienated by his family that he cannot. Wright feels that the only way he can escape his mental imprisonment is by moving to the North, thus creating the North as a symbol of hope. Language functions as a powerful device that portrays white women attacking Wright’s individuality. When Wright searches for jobs and interacts with  white people for the first time, he experiences a double consciousness: how he views himself and how the white women view him. The language that white interviewers use is insulting and depicts how unintelligent they perceive him. After a few interviews Wright â€Å"quickly [learns] the reality- a Negro’s reality- of the white world† (148) as being thought of as dumb witted. The first woman illogically asks Wright if he steals to that white he thinks, â€Å"Only an idiot would have answered: Yes ma’am. I steal† (146). When Wright answers. â€Å"Lady, if I was a thief, I’d never tell anybody,† the lady bluntly states, â€Å"Now, look, we don’t want a sassy nigger around here† (145). The first interviewer seems to believe that black people do not have enough sense to lie abou t stealing, even when they are being interviewed for a job position. She considers a black person with common sense as a â€Å"sassy nigger.† The last interviewer finds it appalling that Wright cannot milk a cow as she mentions, â€Å"You mean to stand there, nigger, and tell me that you live in Jackson and don’t know how to milk a cow?† (149). She places Wright in the stereotype that all black boys from Jackson know how to milk a cow. The fact that she demanded an answer in surprise illustrates the disbelief she feels in finding one black person that cannot milk a cow. The white women stereotype Richard as an uneducated black boy with no level of intelligence and skill. They insult his knowledge and strip him of his individuality believing that all black boys are the same. The white women demean him causing him to leave every interview. The portrayal of the white women labeling Richard Wright as another dumb â€Å"nigger† illustrates how narrow-minded and similar they are to each other. Within Black Boy, language illustrates the racial resentment that the white women feel towards Wright for the color of his skin. Language acts as a device seizing Richard’s individuality and personal respect he obtains for himself. Although Richard Wright’s relationship with violence, family and language teach him that he was no power as an individual, Wright rebels and utilizes these same aspects in an effort to seek some sort of control. Wright’s mother is the first to offer him power through violence. Wright recalls, â€Å"I was baffled. My mother was telling me to fight, a thing that she had never  done before† (17). After Wright fights off a group of boys with a stick and delivers his mother’s groceries he says, â€Å"on my way back I kept my stick poised for instant use, but there was not a single boy in sight. That night I won the right to the streets of Memphis† (18). Although violence acts as a method to teach him of his lower social stance in society, he is able to gain personal power though this same violence. After bearing those boys, he is able to walk freely by himself in peace. In addition, Wright gains power within his family as he refuses to be whipped. After his Aunt Addie whips him in class for walnuts that another boy had left he says, â€Å"I was sure of one thing: I would not be beaten by her again† (107). Many times throughout the novel Richard’s family relatives endeavor to beat him, but he refuses and with that gains power over them and individuality because he will not let them lay a single hand upon him. Wright recalls, â€Å"Aunt Addie took her defeat hard [†¦] I was conscious that she had descended to my own emotional level in her effort to rule me, and my respect for her sank† (110). After Aunt Addie tried to beat him for a fault he did not commit and fails, he begins to feel that he is on the same level of an adult. Furthermore, Wright is able to obtain power and individuality again through language. When Richard is younger he writes a passage about an Indian girl; he says, â€Å"I had never in my life done anything like it; I had made something, no matter how bad it was; and it was mine† (120). Afterwards, Richard shows his written passage to his neighbor and â€Å"her inability to grasp what [he] had done or was trying to somehow gratified [him]† (121). Being able to write gives Richard a strong sense of individuality since it is his creation. Writing the passage also gives Wright a surge of empowerment, as his neighbor cannot fathom why or how he did it. Throughout Black Boy, Richard Wright is inhibited as a person. He is expected to act as a subservient African American. He is insulted and degraded for merely possessing a different color of skin. Wright is restrained by society and learns this oppression when he is violently beaten by white people as well as his family. Wright quickly learns how white people view him as inferior when they insult his intelligence and stereotype  him as a person that will never amount to anything. Richard Wright is constantly belittled as a person, but he uses these same aspects to gain back his power as an individual. He fights a range of people, from a gang of kids trying to take his money to his own family relatives, in order to keep his sense of power. He writes short stories that bring him happiness and confidence and respect. Black Boy offers the life story of Richard Wright’s battle against violence, family differences, and insulting language to uphold his individuality and freedom to be himself against all forces.

After leaving Italy Plato traveled to Egypt, Cyrene, Judea and to the banks of the Ganges. It was said that his mind became a treasure house of the world's wisdom (Thomas & Thomas, 1941). But it was Socrates to whom Plato remained devoted all his life. Plato returned to Athens in 386 to start his Academy, which he patterned after Pythagoras' school in Crotona. Here he immortalized the mental prowess of his master, Socrates, presenting Socratic ideas in the form of dialogues though the mouth of his teacher. He gave us a fair picture of Socrates but little of himself, so that it is hard to tell when Socrates leaves off and Plato takes over. When Plato was sixty (c. 368) Aristotle, then twenty, joined the Academy and continued as Plato's primary student for the next twenty years, until Plato's death in 347 BC. Personal Opinion Merely recalling the name of Plato brings instant and complete admiration in most educational circles. As Alfred North Whitehead put it, it seems that all of Western history is a series of footnotes to Plato. Plato took the liberty of giving his personal philosophy through the mouth of Socrates. The two seem inseparable. Socrates is known to us because Plato took the time to write down the story of his teacher. Everything we know of Socrates was written by Plato. There is no way to know where Socrates' thinking stops and Plato's begins. Body Influences on Plato Plato's early life and writings were very much influenced by Socrates. Plato's beginning works reflected Socrates' thinking, and perhaps ideas that came to him as Socrates was speaking, but which Socrates himself never uttered. As time passed the words of the teacher appeared to reflect the original thinking of the student. In time Socrates became a secondary character, then finally disappeared altogether in Laws (Jaspers, 196 2). Plato and Socrates are distinct in some aspects. They approached life in two utterly different ways. Socrates walked the streets of Athens verbally proclaiming his message while Plato lived in seclusion, away from the evils of society. Socrates was bound to Athens; Plato remained an Athenian but was on his way to becoming a cosmopolitan; he was capable of living and working outside of his native city. Socrates philosophized in the immediate present, Plato indirectly, through his works and the school he founded. Socrates remained in the market place, Plato withdrew to the Academy with a chosen few. Socrates did not write a line, Plato left a monumental work (Jaspers, 1962, p. 121). On their darker sides, the two philosophers shared an acceptance of homosexual attraction between adult males and their young male students that most would not agree with today. In his Symposium Plato creates an argument for homosexual love for boys. He suggests that some men are meant to pursue heaven ly love and some earthy love. Those who look to heaven are more attracted to boys than to women. Why? Because boys are mentally keener, more beautiful, thus closer to the realm of perfection.
